    • Will of his father:

      Itm Whereas my sonne John Comberbache hath formerly putt me to great charges, and cost me a great deale of money in getting him a trade & other necessaries, I doe give him five shillings of currant englishe money in full payment and satisfaction of his childs It and porcon of all my goodes Cattells and Chattells whatsoever for ev[er] hereafter making clayme or p’pertie unto them, or any It thereof but from atten or title of any right hereunto is utterly secluded and barred for ever more by these p[er]seuts.       We that John Cumberbatch late whilest he lived of Helsby in the County of Chester Blacksmith de’d being sick of the sickness whereof hee dyed but of sound and p[er]fect memory and haveing a mind to make his will and dispose of his Estate upon or about the 8th day of February 1664[/65] did nuncupatively & in words without writing express & declare his will & mind as followeth vizt It was his will and mind that all his estate whatsoever should bee devided equally betwixt his three Children Richard Cumberbatch Ralph Cumberbatch and Mary Miller als’ Cumberbatch and likewise his will and mind was that the halfe of his sd daughter’s p’te should bee sett and for the use & benifitt of Elizabeth Miller his Grandchild to the said deced’. And likewise hee expressed that hee had a Sonn in Portingale [Portugal] & if ever hee returned he did give & bequeath him the bed where hee lay to rest his bones upon. And these or the like words in effect hee uttered & declared in ye presence of Thomas Oulton & Edward Cumberbatch and suddenly after departed this life.

      The Condition of this obligacon is such that if they above bounden Richard Cumberbatch [de Helsby in County of Chester Blacksmith] Raphe Cumberbach [Radulphum Cumberbach de Thelwall Wheelwright] and Richard Miller [Richum Miller de Overnley [Alvenley] Agricola [Farmer] et Robert Comberbach de Ovanley [Alvanley] aforesaid yeoman] Sonnes and Sonne in Lawe of John Comberbach late of Helsby in ye County of Chester aforesd dec’d? doe and shall well and truly Administer all & singular his goods rights Credits cattells & Chattells according to ye effect of l[ette]res of Admon to them in yt behalf granted And likewise doe execute & p[er]forme ye last will & testam[en]t nuncupative of ye sd deced. To ye sd l[ette]res of Adm[inist]racon annexed & alsoe doe pay ye debts & legacies bequeathed in ye same will soe [set] forth as the same goods rights Credits Cattells & Chattells will [there]unto extend and the law in yt behalf will bind them And doe make [a true] and p[er]fect Inventory of all the sd deced’ts goods and thereof doe _ ajust accompt unto ye above named Philip Flammer when & af_ _ as they shall be thereunto lawfully called or required.
