  • Notes 
    • This is the last Will and Testament of me Sarah Henshaw Comberbach Spinster of Tillington in the Township of Tillington and Parish of Saint Mary Stafford being of sound mind and memory. I give all the Share and Interest of which I at my death may stand possessed of and in certain property at Eccleshall in the County of Stafford left me by my Grandfather Joseph Henshaw consisting of Two houses one called and known by the name of the Royal Oak and another adjoining with Lands and Buildings belonging thereto now in the occupation severally of Dun and Kinnersley Unto my sister Penelope Ann Henshaw Comberbach and to my brother in law George Marshall of Ward End in the County of Warwick Gentleman their heirs and assigns Upon trust to receive and pay over the rents and profits arising therefrom in three equal shares namely one third share to my dear Mother Sarah Comberbach one third share to my sister Penelope Ann Henshaw Comberbach and one third share to my sister Mary Henshaw Comberbach and at the deceased of any one of the three it shall be divided between the Survivors in two equal parts and at the death of the second the sole survivor shall take the whole of such rents and profits for the term of her natural life And after the decease of such survivor I give and devise my said share and Interest unto my said Trustees their heirs and assigns Upon trust that they on the survivor of them or the heirs executors or administrators of such survivor their or his assigns do and shall if they or he shall think proper but not otherwise sell and dispose of my said share and Interest by Public Auction or Private Contract and the receipts of them or the survivor of them or of the heirs executors and administrators of such survivor their or his assigns shall be an effectual discharge to and purchaser for his purchase money And upon trust as to the clear proceeds of such sale to divide the same into three equal parts and as to the two third parts thereof upon trust to divide and pay the say equally unto and between my nephew John Proud Comberbach my niece Catherine Freer Comberbach and my niece Sarah the wife of Reverend Frederick Goodwin And as to the remaining one third thereof unto my sister Eliza Henshaw the wife of the said George Marshall for her separate use and after her decease then I give such one third art to her son George William Marshall absolutely And in case my said Trustees or Trustee shall think it more advisable or expedient to postpone the sale of my said share and interest or not to sell the same Then I direct that the same shall be valued at the time of the decease of the survivor of them the said three first hereinbefore named Tenants for Life And then I give and devise my said share and Interest to my said Trustees their hers and assigns charged with a sum equal to two thirds of the amount of such valuation to be paid and divided unto and between my said nephew John Proud Comberbach and my nieces above named in lieu of the bequest hereinbefore made to them And subject to such payment Upon trust to pay the rents and profits of the whole of my said share and interest until the sale thereof and after the sale thereof at any time thereafter the interest of the clear invested proceeds thereof unto my said sister Eliza Henshaw Marshall for her life for her sole and separate use and after her deceased I give and devise the whole of my said share and Interest charged as aforesaid or the clear invested proceeds of the sale thereof as the case may be unto my said nephew George William Marshall absolutely And I empower the sale of my said share and interest by may said Trustees in manner aforesaid whenever it shall seem to them advisable or expedient to convert such my said share and interest into money And as to all my personalty I leave it to pay my just debts Funeral expences and the cost of proving this my will and should any surplus remain I desire it may be left in Furniture for the joint use and property of my sisters Penelope Henshaw and Mary Henshaw and to the survivor absolutely I give the sum of Ten Pounds [£10] to my brother Thomas Henshaw Comberbach and as to any money which may be owing to me by him on account of rent or otherwise at my decease I fully remit all payment of the same I leave my wearing apparel Books Trinkets and all other trifles I may possess entirely at the disposal of my dear sister Penelope to keep and distribute as she thinks proper And I appoint my said sister Penelope and the said George Marshall my Trustees and Executrix and Executor of this my only Will In witness whereof I the said Testatrix have to this will contained upon two sheets of paper set my hand this thirteenth day of March one thousand eight hundred and fifty two [13 Mar 1852].
