A TRUCK CASE — Nathan Dunkerley, hat manufacturer, of Gee Cross, was brought before the magistrates of Hyde, a fortnight ago, charged by Charles Cumberbeach secretary to the hatters union, with having paid one of his workpeople in goods instead of money. Mr. Cobbett, solicitor, of Manchester, appeared on behalf of the complainant, and Mr. Hudson, of Stockport, for the defendant. It appeared that the defendant had been in the habit of giving his workpeople tickets to get provisions at a neighbouring shop, in this instance, the tickets, which were given to the person for whom the complainant appeared, amounted to 12s. weekly. The person could not read, but he always understood that sum to be upon the tickets. He had been in the habit of receiving them for a length of time. Mr. Hudson said that he would take a legal objection upon the case as presented before the bench. The person said to have received the tickets was a hat body maker, and no term of that description was to be found in the act. Mr. Cobbett, on the contrary, argued, that although the man’s business was not mentioned, yet it came under the denomination of woollens, which brought it within the meaning of the truck act. The bench, after consulting together, decided to take a legal opinion upon the matter, and adjourned the case for fourteen days. The case was again entered upon on Monday. On the parties being called upon the defendant did not appear. The chairman, Captain Clarke, said, that the conclusion the bench had come to was, that the case came under the truck act. The magistrates, therefore, decided that the defendant must be convicted in the sum of five pounds, one half of which sum would go to the informer, and the other half to the county. Mr. Little was instructed to inform the defendant of the decision of the bench.
