    • In 1969 the law changed allowing divorce to be granted based on 'irreconcilable differences'. In order for a divorce to be granted atleast one of the five faults must occur: (1) Adultery, (2) Unreasonable Behaviour, (3) Desertion, (4) Two years separation with consent of both parties and (5) Five years? separation without consent of both parties.

      In order to obtain a divorce the ?Petitioner? files their petition for divorce and the 'Respondent' can choose to fight the petition for divorce, agree to it or to ignore it. The petition remains secret. A Decree Nisi is issued by a judge and when the specified period elapses then a Decree Absolute can be granted, again by a judge. It is illegal to remarry before a Decree Absolute is issued as this is the point when the marriage has officially ended.

      On 18th November 1971 Patrick Kevin Flack, the Petitioner, was granted a Decree Nisi and three months later on 21 February 1972 a Decree Absolute was granted at Southend County Court and the marriage was dissolved under case number D792/71.

      We speculate that Patrick took advantage of the change of law and filed a petition under the grounds of five years of separation. Mary probably ignored the petition and then the due course of three months had to elapse before the court considered it safe to dissolve the marriage. Had the law not changed then Mary may have never agreed to a divorce.

    • BIRTH: Mary was the youngest of five children.

      SURNAME_HISTORY: Whelan, along with its common variant Phelan, comes from the Irish Ó Faoláin, from a diminutive of faol, "wolf". Taken together, the two names come among the fifty most numerous in Ireland. The family originated in the ancient kingdom of Decies, part of the modern county of Waterford, where they were rulers up to the Norman invasion. A minor branch also settled in the adjoining county of Kilkenny. From this centre, the surname has now spread to the adjoining counties of Kilkenny, Cork, Wexford and, further north, Laois and Carlow. It is also to be found throughout the country, however. Although Whelan is the more common of the two versions, Phelan is the one which has left its mark on Irish placenames, with Kilphelan in Co. Cork and Raheenphelan and Rathphelan both in Co. Laois. .Leo Whelan (1892-1956) was well known as a portrait painter. Seán O'Faoláin, (1900-1991) was born in Cork John Francis Whelan. He was internationally famous in particular for his short stories which present unsparing but compassionate pictures of life in modern Ireland. He was bitterly opposed to the censorship and narrow Catholicism of Ireland in the 1940s and 1950s. His daughter, Julia O'Faoláin (1932 - ) is also a successful novelist and translator. Nuala O'Faoláin (1942 - ) has had a varied career as a feminist, academic and film-maker. She is best known now for her role as an influential and respected social commentator with The Irish Times. Bill Whelan (1950-) is a composer, songwriter and record producer. He is best known now for the music he composed for the hugely successful dance show, Riverdance.

      Whelan/Phelan - The O Faoileain (O'Phelan) chiefs, of Waterford and Kilkenny, were Princes of the Decies. The name Whelan must be dealt with in conjunction with Phelan, as they are anglicized variants of the same Gaelic surname, viz. o Faolain, which itself has variant forms such as O Faoileain and O hAolain. Whelan is more numerous than Phelan: it alone stands seventy-ninth in the list of the hundred commonest names in Ireland; with Phelan added the name takes forty-forty place, with an estimated population of about twelve thousand persons. In the last year for which such statistics are available 214 births were registered for Whelan and 93 for Phelan. Eighty per cent of the latter belonged to Counties Waterford, Kilkenny and adjacent areas; while Whelans extended further into Wexford and Carlow. many, of course, were born in Dublin, but in considerations of this kind the metropolitan area can be disregarded. it is natural that the present day representatives of the sept of O Faolain should be found in the places mentioned, because their chiefs were Princes of the Decies before the Norman invasion, while a branch of the sept was settled a little further north in the south-west part of Co. Kilkenny. One of these, John Phelan, was Bishop of Ossory at the time of the Catholic resurgence under James II. The gentleman who styles himself "O'Phelan, Prince of the Decies" (a claim not allowed by the Genealogical office), was born Whelan; the well-known writer Sean O'Faolain is the son of Denis Whelan. Another distinguished Whelan was Leo Whelan, R.H.A. (1892-1956), the portrait painter. Of those using the form Phelan the best known are Edward Joseph Phelan, the Director-General of the International labour Office, of Co. Waterford, and Frederick Ross Phelan, a distinguished Canadian soldier. In the United States, Phelans have been prominent, notably James Phelan (1824-1892), Leix-born pioneer, and his son James Dubal Phelan (1861-1930), senator and mayor of San Francisco.       RESIDENCE: There is a townland in the Parish of Bruff called Ballyvulhane, Baile Uí Choilleáin in Irish, which means 'the town of O'Collins' (http://www.limerickdiocese.org/heritage/bruff/index.htm). Is this the same as Ballyvolane?

      Her grave is in Streatham cemetery, Garratt Lane, London, SW17, England. On entering the gates either take the immediate right, pass the toilets and follow the road around to the left until you reach a crossroads. The grave is immediately on your left under the big tree. Alternatively, through the entrance gates and straight ahead, second exit on at the round-about with chapel on the left-hand-side of the roundabout, there is another on the right-hand-side also, you should see a WWI memorial roundabout ahead. Turn right and at the next crossroads the grave is immediately to your right under the big tree.
