    • ABRAHAM CARLETON, son of Edward and Ann Carleton. He inherited Cleland and The Farm plantations and other estate under the Will of his grandfather, Abraham Cumberbatch. He assumed the surname Cumberbatch in fulfilment of the terms of the said Will. Married Elizabeth Trent, daughter of Lawrence and Jane Trent. He was a Member of the Council of Barbados for thirty years. He made his Will on 26 April 1785 intending shortly to leave for England. He died there on 25 July 1785 and was buried in Bristol Cathedral by the Precentor on 30 July. A tablet to his memory erected on the north wall of the Choir Vestry of the Cathedral records that he bore a long and painful illness with uncommon patience and fortitude, and came to England in hopes of receiving benefit from a change of climate. (See M. I. Oliver's Caribbeana, Vol II, p. 84.

      His children were:
      1. ABRAHAM CUMBERBATCH, born 1754, who married Mary Cumberbatch Sober, daughter of Cumberbatch Sober. She was his second cousin. After his death she married 20 August 1797 William Smith Forth of the King's Dragoon Guards. Abraham Cumberbatch inherited Cleland and The Farm, and was for some years a Member of Council of Barbados. He went to live in England and died of a malignant fever at his seat Fairwater, near Taunton, on June 16, 1796 in his 42nd year. A tablet to his memory is on the north wall of the north choir of Bristol Cathedral. Erected by his widow. His only child and heir was¬- ABRAHAM PARRY CUMBERBATCH, born in Barbados, baptised 29 November 1784. He married Char¬lotte, daughter of Robert Burnett Jones on 31 October 1805. She died 15 January 1818, and he married secondly, Caroline Chaloner by whom he had issue. Abraham Parry Cumberbach died at Tunbridge Wells October 1840 aged 56. A tablet to the memory of his first wife, Charlotte, is on the north wall of the north gallery of St. Mary, Padding¬ton. See Oliver's Caribbeana, Vol I. p. 228.

      2. LAWRENCE TRENT CUMBERBATCH, died a bachelor in 1834 in Barbados.

      3. EDWARD CARLETON CUMBERBATCH. Part owner with his brother John Trent Cumberbatch in Nicholas and Ebworth plantations. He married Sarah Howell on 9 September 1794, and had two children. He died at Clifton, Bristol, on 9 August 1821, and is buried in Bristol Cathedral.

      A. Edward Carleton Cumberbatch, of whom later.
      B. Sarah Cumberbatch, of whom later.

      4. JOHN TRENT CUMBERBATCH of St. Peter, Barbados. Part owner of Nicholas and Ebworth plantations. He died a bachelor in Liverpool on 19 November 1822 [this is not correct as he was buried 27 Jul 1822], leaving the bulk of his estate to his brother Edward Carleton Cumberbatch.

      5. ANN CUMBERBATCH, married Dr. William Sandiford and had issue two sons.

      Entered 6th January 1834. BARBADOS. In Ordinary. To His Excellency Sir Lionel Smith Knight Commander of the most Honourable Order of the Bath, Governor and Commander in Chief of this Island Chancellor Ordinary and Vice Admiral of the same. The humble petition of Charles Cave residing in the City of London in that part of the United Kingdom of Great Britain and Ireland called England Esquire, the sole executor named in and appointed by the last Will and Testament of Lawrence Trent Cumberbatch late of this Island Esquire deceased. Sheweth, That the said Lawrence Trent Cumberbatch previously to his decease and whilst he was of sound mind and understanding duly made and executed his last Will and Testament in writing bearing date on or about the Thirty first day of March in the Year of Our Lord One thousand eight hundred and twenty nine in the presence of three credible witnesses, John Chase Eversley, Edmund Jordan Eversley and Conrade (sic) Adams Howell who at the request and by the direction of the said Lawrence Trent Cumberbatch severally subscribed their names as witnesses attesting the due execution of the same. That your petitioner Charles Cave is the sole executor nominated and appointed in and by the said Will of the said Lawrence Trent Cumberbatch. That after the said Testator had as aforesaid made and executed his said last Will and Testament he made and executed a Codicil thereto. That the said Codicil is written throughout in the handwriting of the said Lawrence Trent Cumberbatch and was executed by him in the presence of two subscribing witnesses William Howard Rollock and Thomas Smith Harding. That the same is without any date and the seal which had been affixed thereto hath been torn off. That by the said Codicil the said Testator gives and bequeaths to his nephew Edward Carlton Cumberbatch the sum of one thousand pounds Currency to be paid in one year after his death in token of his approbation of his said Nephew's having entered into Holy Orders. And the said Testator in and by the said Codicil gives to the said Edward Carlton Cumberbatch's daughter Rosalie Geraldine five hundred pounds currency she having been born after his the said Testator's said will was made and executed. And the said Testator in and by his said Codicil directs that his two Mulatto slaves namely Mary (alias Mary Hinds) a girl and David (a boy) should be manumitted and set free from all and all manner of slavery or servitude whatsoever. That in as much as the Devises Bequests and Directions contained in this Codicil are wholly comprised in another Codicil subsequently executed by the said Testator hereinafter mentioned and the same appears to have been designedly defaced and set aside in the life time of the said Testator by tearing off the Seal your petitioner is advised that the same is not entitled to Probate. That the said Lawrence Trent Cumberbatch afterwards made and executed another Codicil to his said last Will and Testament in writing bearing date on or about the fifteenth day of January one thousand eight hundred and thirty three. That the same is written throughout in his own handwriting and was executed by him in the presence of the said William Howard Rollock and Thomas Connell and they subscribed their names thereto as witnesses attesting the due execution thereof. That in the said last mentioned Codicil and contained the said legacy or bequest to the said Edward Carlton Cumberbatch of one thousand pounds currency in consideration of his having entered into Holy Orders and also the said legacy or bequests of five hundred pounds currency money by this Island to said Rosalie Geraldine Cumberbatch the daughter of the said Edward Carlton Cumberbatch and likewise the direction to manumit the said slaves named Mary (alias Mary Hinds) and David. And in the said last mentioned Codicil certain other legacies and bequests are made by the said Tesator Lawrence Trent Cumberbatch and certain other slaves are directed to be manumitted set free from all servitude and slavery whatsoever. That the said Testator Lawrence Trent Cumberbatch aftwarwards made and executed another Codicil to his said last Will and Testament bearing date the twenty fourth day of October one thousand eight hundred and thirty three. That the same is written throughout in his own handwriting and was executed by the said Testator in the presence of one witness only the said Thomas Smith Harding. He subscribed his name as the witness attesting the execution thereof. That by the said last mentioned Codicil the said Testator gives and Devises onto one Lizzy Lavine therein particularly mentioned a house in Speights Town in this Island in the manner therein mentioned bequeath to the said Lizzy Lavine an annuity of twenty pounds to be paid her quarterly as therein also mentioned and his remaining tenements and slaves in Speights with the exception of his own dwelling house which he the said Testator therein declared he considered this included in the residuum of his general Estate in his said Will he directs might be sold and the amount divided in such a manner as in his said Codicil. It is also particularly mentioned that the said Testatator Lawrence Trent Cumberbatch made and executed another Codicil to his said Will and it is also written throughout in his own handwriting and is signed by him in the presence of one witness only the said Thomas Smith Harding who subscribed his name as the witness attesting the execution thereof by the said Testator. That to the said last mentioned Codicil there is no date annexed. That in and by the same the said Testator gives and bequeaths to one Coco who he described therein and his nurse and maid servant the sum of fifty pounds currency and certain slaves therein named the sum of ten pounds per annum for a term of two years. That a diligent search has been made amongst the papers of the said Testator Lawrence Trent Cumberbatch and none others of a testamentary nature than those hereinafore mentioned and described have been found the same are now propounded and will on the hearing of the petition be produced before your Excellency in the same state and condition in which they were found at the desk of the said Testator Lawrence Trent Cumberbatch. That your petitioner has advised that the two last mentioned Codicils executed by the said Testator in the presence of one witness only must be established and Probate annexed thereto at the same time. With the said Will and second Codicil and as together containing the last will and Testament of the said Lawrence Trent Cumberbatch deceased. Your petitioner therefore most humbly prays that your Excellency will be pleased to appoint a short date for hearing the merits of this petition and that citations may issue if necessary to your Petitioner's witnesses who can prove the truth of the premises and if upon such hearing matters shall appear as hereinsoforth that your Petitioner may be allowed by the same testimony of one or more of the subscribing witnesses to the said Will and the Codicil. Secondly in his petition mentioned and described to prove the said Will and Codicil as for the Will of the said Lawrence Trent Cumberbatch deceased and a Codicil to the same. And your Petitioner further humbly prays your Excellency that he may be at liberty to prove as well by the testimony that the only subscribing witnesses to the said two Codicils lastly mentioned and described in this petition as by the testimony of the competent witnesses are well aquainted with the handwriting of the said Lawrence Trent Cumberbatch deceased that the same are written throughout in his own handwriting and also signed by the said Lawrence Trent Cumberbatch deceased. And that your Excellency as Ordinary as the foresaid will be pleased to declare that the same Codicil firstly menioned and described in this his petition is set aside and made none effect by the said Testator for the reasons hereinfore mentioned and set forth and to establish the said Will and the said Codicils thereto herein secondly, thirdly and fourthly mentioned as described and to order and direct a Probate maybe annexed in due form of Law to the said Will and the said three last mentioned Codicils as together containing the last Will and Testament of the said Lawrence Trent Cumberbatch deceased and be recorded as such in the Secretary's Office of the said Island of Barbados and take effect as such to all legal intents and purposes whatsoever. And in as much as your Petitioner is at present residing in England the foresaid humbly humbly further prays that the letters of requisition may issue forth from your Excellency as the Ordinary of the said Island of Barbados to be transmitted to England with an attested copy or exemplification of the said last Will and Testament and the said three Codicils herein prayed to be established annexed and directed to the Right Honourable Sir Nichol Knight Doctor of Laws Master Keeper Commissary of the Prerogative Court of the Archbishop of Canterbury his surrogate or surrogates or any other competent judges or judge requiring him and them to administer the Oath prescribed by the law of the said Island of Barbados in order to qualify your Petitioner as the Executor of the said Will and the said three Codicils of the said Lawrence Trent Cumberbatch deceased and that thereupon letters testamentary under the said Will and the said three Codicils may issue from your Excellency out of the said Secretary's Office of this Island to your Petitioner as sole Executor of the last Will and Testament of Lawrence Trent Cumberbatch deceased.       BARBADOS by His Excellency the Governor I do hereby order that the merits of the foregoing be heard before me in Ordinary on Monday next the 6th day of January 1834 at the Government House by 12:00 and that all persons concerned have due notice and do then and there attend. Given at the Government House this 30th day of December 1833. Lionel Smith

      BARBADOS. This is the last Will and Testament of me Lawrence Trent Cumberbatch of the Parish of Saint Peter in the Island of Barbados abovesaid Esquire, I direct that all my just debts and funeral expenses be fully paid and satisfied as soon as possible after my decease. I give and bequeath unto my nephew Edward Carlton Cumberbatch for and during the term of his natural life one annuity or clear yearly sum of three hundred pounds sterling money of Great Britain per annum to be paid to him by half yearly payments on the 25th day of March and the 29th day of September in every year the first payment to be made on the first day of the said days which shall happen after my decease. I also give and bequeath unto my said Nephew all the Silver Plate which was given to me by my deceased sister Ann Sandiford save and except only the Silver Bread Basket. The annuity now bequeathed by me to my said Nephew is in addition to that now payable to him by me under the Will of his deceased father Edward Carlton Cumberbatch. I give and bequeath to my Grand Nephew Lawrence Trent Cumberbatch son of my said Nephew Edward Carlton Cumberbatch the sum of one thousand pounds current money of this Island when he shall attain the age of 21 years with interest thereon from the time of my death until the same shall be paid. And the interest thereof I direct shall be paid to his qualified guardian or guardians to be by him or them applied for his education. And in case my said Grand Nephew Lawrence Trent Cumberbatch shall depart this life under the age of 21 years then I direct that the said legacy or sum of one thousand pounds shall sink into and become part of the residuum of my Estate. I give and bequeath to my Grand Niece, Laurentia Trent Cumberbatch, daughter of my said Nephew Edward Carlton Cumberbatch the sum of five hundred pounds current money of this Island when she shall attain the age of 18 years with interest thereon from the time of my death until the said principal amount of five hundred pounds shall be paid. And the interest thereof I direct shall be paid to her qualified guardian or guardians to be by her or them applied for her education. But in case my said Grand Niece Laurentia Trent Cumberbatch shall depart this life under the age of 18 years then I direct that the said legacy or sum of five hundred pounds shall sink into and become part of the residuum of my Estate. I give and bequeath to my Grand Nephew Stephen Cave son of my friend and Nephew in Law and Niece Charles Cave and Sarah Cave of England the sum of five hundred pounds current money of this Island when he shall attain the age of 21 years with interest thereupon from the time of my death until the said principal sum of five hundred pounds shall be paid. And the interest thereof I direct shall be paid to his qualified guardian or guardians to be by him or them applied for his education. But in case my said Grand Nephew Stephen Cave shall depart this life under the age of 21 years then I direct that the said legacy or sum of five hundred pounds shall sink into and become part of the residuum of my Estate. I give and bequeath unto my Grand Nephew Lawrence Trent Cave son of the said Charles Cave and Sarah Cave the sum of one thousand pounds current money of this Island when he shall attain the age of 21 years with interest thereon from the time of my death until the said principal sum of one thousand pounds shall be paid. And the interest thereof I direct shall be paid to his qualified guardian or guardians to be by him or them applied for his education. But in case my said Grand Nephew Lawrence Trent Cave shall depart this life under the age of 21 years then I direct that the said legacy or sum of one thousand pounds shall sink into and become part of the residuum of my Estate. I give and bequeath to my friend and Overseer of my Plantations Thomas Smith Harding the sum of one hundred pounds current money of this Island to be paid to him in one year after my decease. I give and bequeath to the aforesaid Charles Cave my Chronometer, chain and appendages. It is my Will and I do hereby direct that my following slaves to wit (or Viz:) Charles Ramsay, Isaac Aboab, Billy Trent and Hope (males) and Coco Sandiford (a female) be manumitted in England by my Executor hereinafter named or as the representatives under this my Will for the time being and the expenses thereof to be paid out of my Estate which I direct to be done in consideration of their services and correct conduct towards me. And I give and bequeath to each of the said Charles Ramsay, Isaac Aboab, Billy Trent, Hope and Coco Sandiford the sum of ten pounds current money of this Island. I give and bequeath to Mary Laurentia Lavine, Francis Lavine, Abraham Lavine, George Beckwith Lavine and Lizzy Lavine free coloured persons and their heirs the house in Speights Town which they now inhabit with the land whereon the same stands and thereto belonging. I give and bequeath to each of them the said Mary Laurentia Lavine, Francis Lavine, Abraham Lavine, George Beckwith Lavine and Lizzy Lavine the sum of one hundred pounds current money of this Island payable in one year after my death. I also give and bequeath a part of my wearing apparel to be divided bewteen and amongst the said Francis Lavine, Abraham Levine and George Beckwith Lavine. I give and devise to John Edward Cumberbatch and Richard Cumberbatch free coloured persons the house in Speights Town which they now reside in with the land whereon the same stands and thereto belonging to them and their heirs. I also give and bequeath to each of the said John Edward Cumberbatch and Richard Cumberbatch the sum of one hundred pounds current money of this Island payable in one year after my decease and a proportion of my wearing apparel. I do hereby charge and make liable all my Estate Real and Personal (except the Real Estate I have already mentioned) with the payment of the aforesaid annuity legacies and interest monies. And as to all my Plantations, Lands, Buildings, Slaves, Messuages, Tenements, Hereditaments and all other my Real Estate not hereinfore mentioned and all the residue and remainder of my Estate Real, Personal or Mixed whether in possession, reversion, remainder or expectancy either on this Island or elsewhere (subject and chargeable with the payment of the said annuity, legacy and interest monies) I give and devise and bequeath the same and every part and parcel thereof unto my aforesaid Niece Sarah Cave and her Heirs, Executors, Administrators and Assigns forever. I nominate and appoint my aforesaid friend and Nephew sole Executor of this my last Will and I do hereby revoke and make void all former and other Wills by me at any time heretofore made and declare this only to be my last Will and Testament in testimony whereof I the said Lawrence Trent Cumberbatch have hereto set my hand and fixed my Seal this 31st day of March in the year of Our Lord one thousand eight hundred and twenty nine.       B This is a Codicil to my last Will and Testament bearing date March 31st one thousand eight hundred and twenty nine and witnessed by J.C. Eversley, Edmund Eversley, Conrade Adams Howell Viz: I give and devise and bequeath unto my Nephew Edward Carlton Cumberbatch the sum of one thousand pounds current money of this Island to be paid at the expiration of one year after my death in token of my approbation at his having entered into Holy Orders. And I give, devise and bequeath to Rosalie Geraldine Cumberbatch the daughter of the said Edward Carlton Cumberbatch five hundred pounds current money of this Island when she shall attain the age of 18 years she having been born after the abovesaid Will was made and executed. I give and devise and bequeath to Mary Larry Lavine, Lizzy Lavine, Francis Lavine and George Beckwith Lavine the sum of one hundred pounds currency each in addition to the sum bequeathed to them in my Will. I give devise and bequeath to Edward Cumberbatch and Richard Cumberbatch the sum of one hundred pounds currency in addition to the sum bequeathed in my Will. I direct that the following slaves be manumitted and set free from all and all manner of slavery and servitude whatsoever paying off any contingent expenses that may occur viz: Mary alias May Hinds a young coloured woman and David a coloured boy, Sarah, Mary Margaret (girls) Thomas Hendy, James and Tom Hendy (boys) and the offspring of Thomas Hendy who was heretofore manumitted by me for his faithful services and attachment to me. Item I discharge remit and quit claim to what may appear due and owing to me from Edward Cumberbatch and Francis Lavine at the time of my death.       C BARBADOS. This is an additional Codicil to my last Will and Testament to give unto Lizzy Lavine the house in Speights Town belonging to me commonly called or known by the name of the house formerly occupied by Quamino Ford and directing the same to be paired light and tenantable at the expense of my Estate and a sum of twenty pounds currency to be paid her quarterly in addition to my legacies in former Will and former Codicil and the remaining tenements and slaves in Speights Town, with the exception of my own dwelling house which I consider as included in the residuum of my general Estate in my Will, I desire may be sold and the amot equally divided between the surviving sons of Elizabeth Lavine, Elizabeth Cumberbatch deceased share and share alike. This document to express my additional wishes however imperfect and informal and written under great debility, hurry and agitation I submit to my friend and Exor: Charles Cave for his ratification, calculating on his good will to confirm the whole of mine all in my own handwriting this twenty fourth day of October one thousand eight hundred and thirty three.       D BARBADOS. This is an additional Codicil to my last Will and Testament to give to Coco, whom I have manumitted in said Will, my house and maid servant the sum of fifty pounds currency and the following slaves Agin Bingt Sukey a female and John Thomas and Marcus (boys) and the sum of ten pounds p. ann. [per annum] for the term of two years for the rent of an house for her extraordinary care and attention for and to me in my long and painful illness and confinement. Witness Thos S.       BARBADOS. By His Excellency The Governor at a Court of Ordinary held before me this day the foregoing Petition was read and thereupon Edmund Jordan Eversley, Conrade Adams Howell two of the subscribing witnesses to the last Will and Testament of Lawrence Trent Cumberbatch, deceased person, personally appeared and made Oath on the Holy Evangelists of Almighty God that they were present and did see the said Testator Lawrence Trent Cumberbatch sign, seal, publish and declare the same in due form as and for his last Will and Testament and that he was at the executing thereof of a sound and disposing mind and memory to the best of these Deponents’ judgements and belief and at the same time appeared William Howard Rollock and Thomas Connell the two subscribing witnesses to the Codicil subjoined to the said last Will and Testament marked with letter B and dated 15th day of January one thousand eight hundred and thirty three and made Oath on the Holy Evangelists of Almighty God that they were present and did see the said Lawrence Trent Cumberbatch the Testator sign, seal, publish and declare the same as and for a Codicil to his last Will and Testament and that he was at the executing thereof of a sound and disposing mind and memory to the best of these Deponents’ judgements and belief. And also at the same time appeared Thomas Harding the subscribing witness to the Codicils marked C and D and dated the 24th day of October one thousand eight hundred and thirty three and made Oath on the Holy Evangelists of Almighty God that he was present and did see said Lawrence Trent Cumberbatch the Testator sign, seal, publish and declare the same respectively as and for Codicils to his said last Will and Testament and that he was at the respective times of executing the said Codicils of a sound and disposing mind and memory to the best of his the Deponent’s judgement and belief. And the said Thomas Harding and Thomas Connell also at the same time made Oath that the Codicil marked C and D are respectively written throughout from beginning to end in the proper handwriting of the said Testator Lawrence Trent Cumberbatch. I do hereby declare null and void the first Codicil marked at the foot thereof with the letter A and mentioned in the said petition and allow and approve the said last Will and Testament and the three Codicils marked respectively with the letters B, C and D of the said Testator Lawrence Trent Cumberbatch deceased and order that the same together with this my Probate be recorded in the Secretary’s Office of this Island and take effect to all legal purposes.
